2.2. Work and Learning Behavior Data

Unlike standard platforms, KultureHire tracks "work behavior" and "learning behavior" data. This information is not personally derived but is generated based on your interactions with our job simulations, projects, courses, and platform features.

• Work Behavior: Includes metrics on how you approach tasks, time management, problem-solving patterns, and collaboration style during simulations.
• Learning Behavior: Includes data on course completion, assessment performance, and skill acquisition rates.

3. Consent and Permissions

3.1. Work Behavior Tracking

You consent to KultureHire tracking, analyzing, and storing your work and learning behavior data. This data is essential for assessing your employability and providing detailed feedback.

3.2. Data Sharing for Hiring

You agree that your work behavior, learning behavior, and relevant profile information may be shared with:

• Employers: To make informed hiring decisions based on verified skill demonstration.
• Instructors and Mentors: To provide personalized guidance and feedback.
• Project Posters: Individuals or entities who post gigs or projects on the platform.

This sharing is conducted strictly for the purpose of facilitating employment, internship, or mentorship opportunities.

3.3. No Resale of Data

We commit that your personal information will never be resold to third-party marketing agencies or external entities for commercial purposes unrelated to the services provided by KultureHire.

3.4. Business Transfer

In the event that KultureHire is acquired by or merged with another company, you consent to the transfer of your personal information and behavioral data to the acquiring entity. This transfer ensures the continuity of your service and history on the platform.

4. Code of Conduct and Fair Usage

Integrity is the core of KultureHire. To ensure a fair ecosystem for all talent:

• No Cheating: You agree not to use unauthorized assistance, bots, or unfair means to complete job simulations, assessments, or projects.
• Fair Participation: You will behave professionally and ethically. You agree not to manipulate the platform's metrics to create a false impression of your skills or work behavior.
• Respectful Interaction: You will maintain a professional tone in all interactions with mentors, employers, and fellow peers. Harassment or abuse of any kind will result in immediate termination.

Violating these terms will result in immediate suspension or permanent ban from the platform.

5. Confidentiality and Non-Disclosure

Given the nature of job simulations, you may be exposed to simulated proprietary information or specific methodologies.

5.1. Protection of Work Files

Strict Confidentiality: Any work files, documents, code, or assets you create or access during a job simulation program are strictly confidential. You generally agree not to reveal, publish, or share the actual work files with any public third party.

5.2. Non-Disclosure of Processes

You agree not to disclose information regarding:

• The internal processes of the job simulations.
• Specific methodologies used in the evaluation.
• Specific feedback received, except as permitted below.

5.3. Permitted Disclosures

You make an exception to the above clauses only for the purpose of professional improvement. You may share your work files and performance feedback privately with:

• Potental Employers: To demonstrate your capability.
• Instructors/Mentors: To receive constructive criticism and guidance.

Sharing on public repositories (like public GitHub repos) or social media feeds without redaction of proprietary simulation details is prohibited unless explicitly authorized.

6. Grievance Redressal

We value your feedback and are committed to resolving any issues you face.

7. Intellectual Property Rights

KultureHire Content: All content included on the Platform, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Platform, is the property of KultureHire or its suppliers and protected by copyright and other laws.

User Content: By submitting, posting, or displaying content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such content in any and all media or distribution methods (now known or later developed), primarily for the purpose of providing and improving the Services.

8. Limitation of Liability

To the maximum extent permitted by applicable law, KultureHire shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; or (c) unauthorized access, use or alteration of your transmissions or content.
